Much is written about the damage that can be done to families who go through the Court process.
The collaborative process offers a client-led, lawyer supported
alternative to this.
Collaborative law involves both parties instructing a collaborative lawyer and then the
clients and lawyers sit around a table and thrash out a solution to any issues arising
in a constructive way, all discussions being underpinned by the principle that they will
not issue or threaten Court proceedings, which demonstrates a commitment to
resolve all issues in a conciliatory way.
As with mediation, a collaborative approach is conducive to good ongoing
communication between the couple. Collaborative law is a good option for a client
who requires a greater amount of lawyer support than the mediation model gives
as the client has their own lawyer who is present at every meeting.
